nintendo vs yuzu
Here on the blog we share part of the follow-up to Nintendo 's lawsuit against Project Yuzu , which the Yuzu developers accepted a few days after receiving it, without making any attempt and reaching an agreement that included closing the project and paying Nintendo $2.4 million in compensation.
After that , several projects began to emerge, which were basically forks of Yuzu, including Suyu, which also fell due to Nintendo's complaints.
Nintendo has labeled the Yuzu emulator as "a tool that circumvents technical security measures and uses illegally obtained cryptographic key copies." This comes after the Yuzu emulator's creators publicly stated that most users employed pirated keys. Furthermore, the Yuzu website offered instructions for extracting keys and mentioned the need to transfer certain files from a hacked console. Nintendo used these actions as grounds to accuse the project of promoting piracy and unauthorized copying of games.
Please provide a detailed description of the original copyrighted work that is claimed to have been infringed. If possible, include a URL where it is posted online.
The Nintendo Switch console and video games contain technological protection measures (“TPM”) that allow the Nintendo Switch console to interact only with legitimate Nintendo video game files. This process protects copyrighted Nintendo video games, including, but not limited to, those covered by US copyright registration numbers PA0002213509 (Super Mario Maker 2); PA0002233840 (Animal Crossing: New Horizons); PA0002213908 (Luigi's Mansion 3); and PA0002028142 (The Legend of Zelda: Breath of the Wild) by preventing users from playing pirated copies of Nintendo video games on the Nintendo Switch console and by preventing users from illegally copying and playing Nintendo video games on unauthorized devices.
Now, as reported by TorrentFreak , Nintendo has (again) filed a DMCA notice with GitHub , in which it originally selected more than 100 repositories that Nintendo suggested provided access to Yuzu or code based on it.
In this request, GitHub not only complied with the blocking of the aforementioned repositories, but many more were affected, totaling 8535 repositories with forks of the Yuzu emulator that were blocked due to the accusation that these projects circumvent the security technologies used in Nintendo Switch consoles.
"Because the reported network containing the allegedly infringing content had more than one hundred (100) repositories, and the submitter claimed that all or most of the forks were infringing to the same extent as the parent repository, GitHub processed the notice of deletion against the entire network of 8.535 repositories, including the main repository»
In addition, it is mentioned that GitHub's notice added that all owners of core repositories had been contacted to give them the opportunity to make changes , instruct them on how to file a DMCA counter-notification, and offer them legal recourse if necessary (something that was not really feasible given the events that occurred with Yuzu).
In this way, Nintendo is sending a powerful unspoken message: it " wants to see the project buried " and any derivatives of it at all costs. This all-out war that Nintendo has declared against Nintendo Switch emulators is no joke for the company, as it seems the final straw was the "losses" it suffered due to the leak of "The Legend of Zelda: Tears of the Kingdom ," a pirated copy of which was available a week and a half before its official release.
This caused the company's anger, since the fact that there is an emulator that allows you to bypass technical protection measures and use cryptographic keys to decrypt games and firmware. Although key extraction falls on the users and is done with external tools, Nintendo considers the mere act of decryption in the emulator to be an illegal circumvention of protection measures, even if the keys are extracted from legal copies (although the user have rights to use those copies only on the original platform).
